Merchant Application Online Disclosure

By submitting a merchant application, lead form, or request for services through Sierra Merchant Solutions LLC (“SMS,” “we,” “us”), you acknowledge and agree to the disclosures below.

1. No Guarantee of Approval

Submitting an application or inquiry does not guarantee approval. Approval, pricing, and terms are determined by underwriting criteria of acquiring bank(s), processor(s), and related partners.

2. Accuracy of Information

You agree that the information you submit is accurate and complete to the best of your knowledge. Incomplete or inaccurate information may delay processing or result in a decline.

3. Authorization to Verify Information

You authorize SMS and our processing/underwriting partners to verify the information you provide, including through:

  • Business databases and public records
  • Identity verification and fraud prevention checks
  • Bank account validation (when applicable)
  • Contacting you and/or your business references

4. Credit Checks (Where Applicable)

Depending on the product and underwriting requirements, you authorize SMS and our partners to obtain consumer and/or business credit reports on business owner(s), principal(s), or guarantor(s) as permitted by law for underwriting, account review, and risk monitoring.

5. Sharing Information With Partners

You authorize SMS to share your application and supporting information with acquiring banks, processors, gateways, POS providers, and other service providers involved in evaluating, onboarding, and supporting your account.

6. Electronic Records & E-Signature Consent

You consent to receive disclosures, notices, and communications electronically (for example, via email, web portal, or electronic signature platform). You agree that your electronic submission, acknowledgement checkboxes, typed name, and/or e-signature may constitute your legal signature.

7. Communications Consent (Email)

By providing your email address, you consent to receive communications related to your inquiry and account. You may also receive marketing emails; you can unsubscribe at any time using the link in the email (we use platforms such as Constant Contact).

8. Communications Consent (Phone/Text)

If you provide a phone number, you consent to receive calls and messages related to your inquiry, onboarding, and support. For marketing calls/text messages, we recommend a separate optional checkbox on the application form (see below).

Required (1):

Required (2) if e-sign is used:
☐ I consent to electronic records and signatures, and to receive disclosures and notices electronically.

Optional marketing (recommended separate):
☐ I agree to receive promotional emails and marketing communications from Sierra Merchant Solutions. I can unsubscribe at any time.
☐ I agree to receive marketing calls/text messages (autodialed or prerecorded where permitted). Message/data rates may apply. Consent is not a condition of purchase.
